Online Privacy Notice

Introduction.

 

(a)  Website Owner. Vext Science, Inc. (“Vext”) is the owner of the websites www.herbalwellnesscenter.com (the “Vext Website”). Vext can be contacted by mail at 4152 N. 39th Avenue, Phoenix, AZ, 85019, by phone at 602-910-4152, or by email at info@herbalwellnesscenter.com. This online privacy notice discloses the information practices for the Vext Website, including what type of personal identifiable information is requested in order to place an order, how the information is used, and with whom the information is shared.

(b)  Website Visits. In general, you can visit the Vext Website without disclosing any personal information. Vext does not keep track of the domains from which people visit us.

(c)  Website Transactions. At times, Vext will need personal information regarding a customer or a potential customer. For example, to process an order or schedule a visit to one of our locations, Vext may need to know a customer’s name, mailing address, email address and other information about you. It is Vext’s intent to inform you before Vext collects personal information, such as user’s name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, Vext will respect your wishes.

Personal Information That May Be Collected.

(a)  Identifying Information. In order to place an order, Vext will request a user to provide certain personal identifying information, which may include: name, postal address including ZIP code, email address, date of birth and telephone number. We do not accept payment on the Vext Website, so we will not ask you for your credit card number or other payment information. However, Vext may request additional information necessary to establish and maintain customer’s account. In addition, the Vext Website may contain links to other websites owned and operated by other organizations and those websites may collect information from you, including credit card numbers or other information to process payment for goods and services you order from them.

(b)  Service Quality Monitoring. Some Website transactions may require a customer to telephone Vext, or Vext to call the customer. Vext will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customers should be aware that it is Vext’s practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.

(c) Information from Minors or Adults Under the Age of 21. Vext does not sell products or services for purchase by people under the age of 21, and will not collect or post information from a person under the age of 21 without the involvement of a parent or guardian. If a minor provides us with personal information, Vext will notify a minor’s parent or guardian at the email address provided by the prospective customer, alerting the parent or guardian to the minor’s use of the Website and providing instructions as to how the parent or guardian can delete the child’s registration from the Website.

(d)  Lost or Stolen Information. If a customer’s password is lost or stolen, the customer should promptly notify Vext in order to enable Vext to cancel the lost or stolen information and to update its records with a changed password.

(e)  Links to Other Websites. The Vext Website may contain links to other websites owned and operated by other organizations. Vext is not responsible for the privacy practices or the content of those other websites.

Uses Made of the Information.

(a)  Limited Uses Identified. Without customer’s prior consent, Vext will not use your personal identifiable information for any purpose other than that for which it is submitted. Vext uses personal identifiable information to process orders, reply to inquiries, handle complaints, provide operational notices and in program recordkeeping. If requested and authorized by the customer, Vext will also use your personal identifiable information to enroll you in our loyalty programs, sweepstakes and to send you surveys. Submitting your email address anywhere on the Vext Website may result in your e-mail address being added to the Vext email list and our service provider’s and/or marketing partner’s email list. You may unsubscribe from our emails at any time by opting out of email subscriptions with the “unsubscribe” link, which is included in each email. If you opt out, your email address will be removed from our marketing list. Please allow us a reasonable period of time in order to satisfy your request, as some promotions may already be in process.

(b)  Marketing Uses. Unless the customer opts out in the manner described on the Vext Website, Vext reserves the right to provide customer with information about Vext’s Websites, Vext’s products and services, and related information in which customer has indicated an interest.

(c)  Stored Information Uses. Vext stores the information entered on the Vext Website. Stored information is used by Vext and Vext agents: to support customer interaction with the Vext Website; to prepare customer purchases; and/or to contact customer again about other Vext services and products.

(d)  Online Advertising. Some companies that help Vext deliver interactive online advertising, such as banner ads, may collect and use information about Vext’s customers to help Vext better understand the types of advertising or promotions that are most appealing to Vext’s customers. After it is collected, the information is aggregated so it is not identifiable to a specific individual.

(e) Other Uses. Vext may also use your information when it is necessary for us to provide it to our attorneys, accountants, regulators, auditors or other advisors; or otherwise for any other purpose as we are required or permitted by law or required to comply with legal process served upon us, our agents, clients, representatives or our affiliates.

Disclosure of the Information.

(a)  Within Corporate Organization. Vext is a multinational organization, with legal entities, business processes, management structures, and technical systems that cross borders. Vext may share your personal information within the Vext corporate organization, and may transfer the information to countries in the world where Vext conducts business. Some countries may provide less legal protection for customer personal information than the United States.

(b)  Mergers and Acquisitions. To develop and expand its business, Vext may share, rent, sell, or buy business assets. In such transactions, customer information is generally one of the transferred business assets. Also, in the event Vext is acquired, customer information will be one of the transferred assets.

(c)  Agents. Vext employs or engages other companies and individuals to perform business functions on behalf of Vext. These affiliated businesses are provided with personal identifying information required to perform their functions. These businesses engage in a variety of functions which include, but are not limited to, transmitting customer orders, administering customer loyalty programs, removing repetitive information from customer lists, analyzing data, providing marketing assistance, and providing customer services.

(d)  Marketing Analysis by Third Parties. Vext reserves the right to disclose to third parties personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.

(e)  Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure under judicial, regulatory or other government subpoenas, warrants or orders.

Use of Computer Tracking Technologies.

(a) No Tracking of Personal Information. Vext’s Website is not set up to track, collect or distribute personal information not entered by visitors. Through Website access logs, Vext does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our site. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.

(b)  Use of Cookies. Vext, or its third-party vendors, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a Website can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by Vext or its third-party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set its browser to turn off cookies; however, some Websites may not then work properly.

(c)  Use of Web Beacon Technologies. Vext may also use Web beacon or other technologies to better tailor its Website to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Website, a non-identifiable notice of that visit is generated which may be processed by Vext or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non- identifiable cookie information and are disregarded.

(d)  Collection of Non-Identifiable Information. Vext may collect non- identifiable information from user visits to the Vext Website in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the Vext Website; Website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Vext or its contractors may use this data to analyze trends and statistics.

(e)  Collection of Personal Information. Vext collects personal identifying information from the customer during a transaction. Vext may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Vext understand trends and patterns. This information is not reviewed at an individual level.

(f)  Google Analytics. Vext’s Website may use Google Analytics to help analyze how users use the site, which uses cookies. The information generated by the cookie about your use of the Website (including IP address) is transmitted to Google. This information is then used to evaluate visitors’ use of the website and to compile statistical reports on website activity for Vext. Google Analytics collects information anonymously. Google will not associate your IP address with any other data held by Google. Neither Vext nor Google will link, or seek to link, an IP address with the identity of a computer user. We will not associate any data gathered from this site with any personally identifiable information from any source, unless you explicitly submit that information via a fill-in form on our Website. It reports website trends without identifying individual visitors. Information Security.

(a)  Commitment to Online Security. Vext employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. We do not collect billing or payment data. Personal information is accessible only by staff designated to handle online requests or complaints. All Vext agents and contractors with access to personal information on the Vext Website are also bound to adhere to Vext security standards.

(b)  No Liability for Acts of Third Parties. Vext will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Vext shall not be liable for unauthorized disclosure of personal information due to no fault of Vext including, but not limited to, errors in transmission and unauthorized acts of Vext staff or third parties.

(c)  Limitation of Liability. YOU UNDERSTAND AND AGREE THAT ANY DISPUTE OVER PRIVACY IS SUBJECT TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, AS WELL AS THE TERMS AND CONDITIONS OF THE VEXT WEBSITE. YOU AGREE THAT OUR LIABILITY TO YOU IN RESPECT OF ANY LOSS OR DAMAGE SUFFERED BY YOU FOR ANY BREACH OF THIS PRIVACY POLICY OR FOR ANY REASON WHATSOEVER RELATED TO THE USE OF THE VEXT WEBSITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD) TO THE EXTENT SUCH CLAIM IS NOT OTHERWISE BARRED BY OUR TERMS AND CONDITIONS.

Privacy Policy Changes and Opt-Out Rights.

(a) Changes to Privacy Policy. Our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by applicable law. By continuing to access the Vext Website or providing us with Personal Information after we have posted an updated Privacy Policy, you consent to the revised Privacy Policy and practices described in it.

(b) Opt-Out Right. Customer has the right at any time to cease permitting personal information to be collected, used, or disclosed by Vext and/or by any third parties with whom Vext has shared and/or transferred such personal information. This right of cancellation may be exercised by contacting Vext via 602-910-4152email at info@herbalwellnesscenter.com by calling 602-910-4152 or by sending certified postal mail to Vext Science, Inc., ATTN: Website Privacy, 4152 N. 39th Avenue, Phoenix, AZ, 85019. After processing the cancellation, Vext will delete customer or prospective customer’s personal information from its database.

Access Rights to Data.

(a)  Information Maintained by VEXT. Upon customer’s request, Vext will provide a reasonable description of customer’s personally identifiable information that Vext maintains in its data bank. Vext can be contacted by e- mail at info@herbalwellnesscenter.com, telephone at 602-910-4152 or by sending certified postal mail to Vext Science, Inc., ATTN: Website Privacy, 4152 N. 39th Avenue, Phoenix, AZ, 85019 for this purpose.

(b)  Corrections and Changes to Personal Information. We rely on our customers to help Vext keep customer personal information accurate. If customer’s personal information changes, or if customer notes an error upon review of customer information that Vext has on file, please promptly email Vext at info@herbalwellnesscenter.com and provide the new or correct information.

(c)  Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Vext who are California residents to request certain information regarding Vext’s disclosure of personal information for their direct marketing purposes. To make such a request, please write to: Vext Science, Inc., ATTN: Website Privacy, 4152 N. 39th Avenue, Phoenix, AZ, 85019. Within 30 days of receiving such a request, Vext will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Vext reserves its right not to respond to requests submitted other than to the address specified in this paragraph.

California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.
